Freelance Solutions Policy


You (the client) are employing Burgess Freelance Solutions to develop a "digital product" and you agree to provide us with all the materials required to successfully complete the digital product. The materials required may be but are not limited to, images, text, video, audio, etc. as well as any other information we may require to complete the digital product as per your specifications within the design brief.

You also agree to review our work and provide feedback within 5 business days or receipt of the digital proofs or online links to assess your product.

If the agreed materials are provided later than the time frames required to deliver the digital product on time, Burgess Freelance Solutions are not responsible for the delay of the digital product delivery.

In the event that you (the client) will not deliver the agreed materials that are required for the projects development or will not provide feedback within the specified period of time we have agreed upon, we reserve the right to suspend your project and resume it in our next available spot.

All communication will be via e-mail, this facilitates a "paper trail" for future reference if required. Live chat will be used if you (the client) have issues that cannot be resolved via e-mail.

Privacy Policy


Any information provided by you (the Client) to Burgess Freelance Solutions or its contractors, regarding your business or business practices will be held in the strictest of confidence and the information will only be used to provide you (the client) with the requested digital project.

You (the Client) agree to keep the correspondence between yourself and Brett P Burgess Freelance Solutions confidential and not share it with or forward it to any third parties without the express approval of Burgess Freelance Solutions.

Burgess Freelance Solutions acknowledges that during the period of employment that, we may have access to and become acquainted with various trade secrets, inventions, innovations, processes, information, records, and specifications owned or licensed by the Client and/or used by the Client in connection with the operation of its business including, without limitation, the Client’s business and product processes, methods, customer lists, accounts, and procedures.

Burgess Freelance Solutions agrees that we will not disclose any of the aforesaid, directly or indirectly, or use any of them in any manner, either during the term of this employment or at any time thereafter, except as required in the course of this engagement with the Client.

All files, records, documents, blueprints, specifications, information, letters belonging to the Client shall remain the exclusive property of the Client.

Any notes, media lists, original artwork/creative, notebooks, and similar items relating to the business of the Client, whether prepared by Burgess Freelance Solutions or otherwise coming into his/her possession, shall remain the exclusive property of the Client upon completion of the project.

Copyright and Usage


Website Designs: Upon the delivery of the digital product, the copyrights are automatically transferred to you (the client). This includes the "full content" of the website.

Graphic Designs: Upon the delivery of the digital design the copyright is automatically transferred to you (the client).

Intellectual Property:

You (the client) may NOT claim that you (the client) created the digital project. All image copyright is owned by the respective photographers / graphic artist.

You (the client) either own or have permission from Burgess Freelance Solutions to use all the materials (supplied within the digital project) such as fonts, texts, photographs, graphics, media or other artwork.

You (the client) will provide if required the necessary proof of ownership of all "media" that you supply for use in the project.

You (the client) agree to cover all costs, expenses and fees that we may incur as a result of any claims or disputes that may arise due to your lack of the ownership or permission to use the materials that you (the client) provided.

Fees - Payment


Fees:

Fees must be paid in advance of receipt of the digital product via our online store.

Burgess Freelance Solutions reserves the right to change its fees without notice.

Burgess Freelance Solutions reserves the right to deny services to any client.

Payment:

All Payments are invoiced in Australian Dollars (AUD).

All payments are to be made through PayPal.

Why PayPal? Safer - Your financial information is securely encrypted within on PayPal servers so you can shop with confidence.

Flexible - Add all your cards and bank accounts and choose which one to use at checkout. You do not need money in your PayPal account to shop.

If we have not received your payment within 10 workings days from the initial contact date, the project will be cancelled.

Shipping - Cancellation - Refunds


Design Concept purchases are usually emailed to you within 7-10 business days of receiving payment.

Made to order custom Websites will require between 4 - 8 weeks.

Documents, Templates, Spreadsheets and Database purchases are usually available within five business days of receiving payment.

All purchases are digital and will be sent to the client via email, or made available for download.

All cancellation requests must be sent to Burgess Freelance Solutions before close of business by the 3rd working day after the purchase.

Design Concept Orders: If for any reason you are not happy with the website or it is not what you expected, you may ask for a new Design Concept as long as it is within 7 working days of receiving the original website, and one will be provided at no extra cost.

Due to the very low cost involved with Design Concepts, a refund will only be considered in exceptional circumstances.

Made to Order Website:

Custom Built Website sales and software sales are final, after work has started.

No refunds will be provided once we have started to code the site or the software.

Graphic Design


Graphic/s Design Orders:

If for any reason you are not happy with the Graphic/s or it is not what you expected, you may ask for a new Graphic as long as it is within 5 working days of receiving the original Graphic/s, and one will be provided at no extra cost.

Logo Designs:

Once accepted by the client all logo purchases are final.

Software Development


MS Office™ orders:

If for any reason you are not happy with the Document/s, Template/s, Spreadsheet/s and Database/s or it is not what you expected, you may ask for changes to be made, as long as it is within 7 working days of receiving the product, and the changes will be done at no extra cost.

PC Game Orders:

If for any reason you are not happy with the Game or it is not what you expected, you may ask for the Game to be re-designed as long as it is within 2 working days of receiving the original Game, and one will be provided at no extra cost.

End User Licence Agreement

IMPORTANT NOTICE Read and understand this License Agreement carefully before installing and using the Software. It contains extremely important information.
BY USING THE SOFTWARE IN ANY WAY YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND AND AGREE TO THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SOFTWARE IN ANY WAY, AND PROMPTLY RETURN IT OR DELETE ANY COPIES OF THIS SOFTWARE IN YOUR POSSESSION.

LICENSE GRANT the copyright holder grants you a non-exclusive license to use this software, and any associated documentation ("The Software"), as indicated herein.
INSTALLATION POLICY: You are authorised to install the software on any computers that YOU  own and operate. 
This allows you to install this software on your home / office computer, and laptop/s. You MAY NOT share the software with another user!

RESTRICTIONS You MAY NOT: (a) sell or distribute the Software package without prior written approval (b) cause or permit reverse engineering, disassembly, decompilation or alteration of this Software; (c) remove any product identification, copyright notices, or other notices or proprietary restrictions from this Software.
TERM: This License is effective until terminated. You may terminate it at any time by destroying the Software, together with all copies thereof.

This License will also terminate if you fail to comply with any term or conditions of this Agreement. Upon such termination, you agree to destroy the Software, together with all copies thereof.
COPYRIGHT/OWNERSHIP The Software packages developed for you are products of Brett P Burgess, and are protected by copyright, trade secret and other intellectual property laws.

CHANGE IN POLICIES: Brett P Burgess reserves the right to change these policies at any time. While it is not our intention to do so, there may be factors outside of our control that require us to implement changes to our policies.

THE SOFTWARE IS PROVIDED BY THE COPYRIGHT HOLDERS AND CONTRIBUTORS "AS IS" AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. The software was created to be free of defects and is designed to function on PC computers only. While this software has been tested and proven to run accurately, in the unlikely event of any user or computer incompatibility issues, the end user assumes complete liability of usage.

The software contains no adware, scumware or spyware. The maker of this software does not support any questionable forms of use where this software could be misused in any way.

WARNING: This software is designed to work exclusively with Microsoft Office®. Other software may run the product, however Brett P Burgess takes no responsibility for the software product if used on anything other than Microsoft Office®.

CANCELLATION / REFUND POLICY: All cancellation requests must be sent to Burgess Freelance Solutions before close of business by the 3rd working day after the purchase.

Digital Project Termination


Both of the sides of the agreement reserve the right to terminate the project by providing a written notice.

User Acceptance Testing (UAT) is to be carried out by you (the client) no later than 5 working days after the digital project is provided.

If you (the client) accept the digital project after UAT then the project is deemed to be complete.
